What do I legally need to do before getting married?
First, you need to apply for a marriage license online with the Births, Deaths and Marriages at the Department of Internal Affairs. There is a fee of $150. You will need to choose either a personalised ceremony (fees as set by the celebrants) or a registry ceremony (a set fee of $90). You also need to provide information about yourself, at least one of your parents, your partner, and at least one of your partner’s parents.
However, if you or your partner is 16 or 17 years old, you must use a paper form to apply. Before you can do that, you will need consent from a Family Court judge. To apply for the consent, each one of you, who are 16 or 17 years old, need to fill out the following 3 forms: Application form for order (or declaration) on notice; General Affidavit form; Information sheet to accompany applications. If you both are 16 or 17 years old, each of you need to fill out the 3 forms separately. If only one person is 16 or 17 years old, then only this person need to fill out all three forms.
Once you receive a Court Order, you will need to give this to Births, Deaths and Marriages at the Department of Internal Affairs when you apply for a marriage license. It generally takes 3 working days to process the application, and the marriage license expires after 3 months.
